Extraterritorial jurisdiction in the European Union (REDRESS-FIDH report)

This report aims to increase general knowledge of the issues surrounding the exercise of extraterritorial jurisdiction, and universal jurisdiction in particular, in the European Union (“EU”). It will give an overview of the current laws and practices of EU member states concerning extraterritorial jurisdiction for prosecution of crimes under international law, assess the extent to which there are similarities or differences in the legislation, and aims to identify common hurdles or issues requiring action and to assess whether additional measures are needed. Part VI gives a summary of key legislation and procedural issues related to extraterritorial jurisdiction in each of the states surveyed. It is hoped that this will provide a helpful reference guide and a useful starting point for victims, nongovernmental organisations, lawyers and government agencies alike.

This report examines the legislation and practice of the 27 EU member states, as well as that of Norway and Switzerland. For convenience throughout the report references and observations as to the law and practice of “EU member states” will be taken to include consideration of these two additional countries.
