Strengthening Eurojust – The Exchange of Information

Article 13 of the amended Eurojust Decision (see Council Decision 2009/426/JHA) creates a general obligation for Member States to exchange with Eurojust “any information necessary for the performance of its tasks". These tasks are to improve co-ordination and co-operation between investigating and prosecuting authorities in the Member States, and to provide support to them generally. The information will allow Eurojust to cross-check for links to cases in the Eurojust Case Management System, to offer assistance to Member States at an early stage, and to provide operational and strategic feedback to national authorities.

The obligation to transmit information applies from 4 June 2011 at the latest and specifically includes information about:

  • Joint Investigation Teams
  • Cross border cases of particular gravity
  • Cases involving (potential) conflicts of jurisdiction, controlled deliveries, repeated problems in judicial cooperation.
